WAIVER AND RELEASE OF LIABILITY

Abandoned Building Tours and Walk-Throughs

I, the undersigned participant, hereby acknowledge and agree to the following terms and conditions in consideration for being permitted to enter and participate in tours, walk-throughs, or other activities at the abandoned or historic property known as:

1. ACKNOWLEDGMENT OF RISK

I understand and acknowledge that entering an abandoned building involves inherent and known risks, including but not limited to:

Structural instability, falling debris, uneven floors, weak staircases, and deteriorated ceilings

Broken glass, exposed nails, sharp objects, and hazardous materials

Poor lighting, limited visibility, and confined spaces

Presence of mold, dust, asbestos, lead paint, or other environmental hazards

Wildlife, insects, or vermin

Slips, trips, falls, and other physical injuries

Psychological or emotional distress, including fear, anxiety, or panic

I voluntarily choose to enter the property fully aware of these risks.

2. ASSUMPTION OF RESPONSIBILITY

I accept full responsibility for my actions and safety while on the property. I agree to follow all posted rules, verbal instructions, and safety guidelines provided by property owners, operators, guides, or representatives.

3. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless the property owner(s), operator(s), manager(s), tour guide(s), employees, volunteers, agents, and affiliates from any and all claims, demands, causes of action, or liability arising out of or related to:

Personal injury, illness, or death

Property damage or loss

Emotional or psychological effects

This release applies whether such claims arise from negligence or otherwise, except in cases of gross negligence or willful misconduct where prohibited by law.

4. MEDICAL CONSENT AND FITNESS

I affirm that I am physically and mentally capable of participating in this activity. I understand that medical assistance may not be readily available on site. In the event of injury or illness, I consent to receive emergency medical treatment at my own expense.

5. PERSONAL PROPERTY

I understand that I am responsible for all personal belongings brought onto the property. The released parties are not responsible for lost, stolen, or damaged items.

6. PHOTOGRAPHY, VIDEO, AND RECORDINGS

I understand that photography, audio recording, and video recording may occur during tours. I grant permission for my image, likeness, or voice to be used for promotional, educational, or documentation purposes without compensation unless otherwise stated in writing.

7. MINORS

Participants under the age of 18 must have this waiver signed by a parent or legal guardian, who agrees to all terms on the minor’s behalf and accepts full responsibility.

8. SEVERABILITY

If any portion of this waiver is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9. GOVERNING LAW

This waiver shall be governed and interpreted in accordance with the laws of the State of
